1. Acceptance of terms
By downloading, installing or using OwnAutoCare, you agree to these terms of use. If you do not agree, please do not use the application.
2. Description of service
OwnAutoCare is a free application for iOS, iPadOS, macOS and Android that allows you to record and manage your vehicle maintenance history. Data is stored in your personal Google Drive account or, on Apple devices, optionally in your iCloud.
The information, calculations and reminders generated by OwnAutoCare are for informational and personal organisation purposes only. They do not constitute technical, legal, mechanical or any other form of professional advice and must not be treated as such.
3. Storage account
To use OwnAutoCare you need to sign in with a Google account (Google Drive) or your Apple ID (iCloud, available on iOS and macOS). By signing in you grant the application permission to create and manage your data in the chosen storage service. You are responsible for maintaining the security of your account.
4. Appropriate use
OwnAutoCare is designed for personal vehicle maintenance management. You must not:
- Attempt to access other users' data
- Modify, decompile or reverse-engineer the application
- Use the application for illegal purposes
5. Your data
You are the sole owner of the data you enter into OwnAutoCare. The application does not store or have access to your data outside of your personal storage service (Google Drive or iCloud). See our privacy policy for more details.
6. Reminders and notifications
OwnAutoCare includes local reminder and notification features. By using these features, the user expressly accepts the conditions and limitations set out below.
6.1. Technical nature of notifications
Notifications generated by OwnAutoCare are exclusively local notifications that are scheduled and executed on the user's own device, without the involvement of external servers. OwnAutoCare does not operate any remote notification delivery system and therefore cannot control, monitor or guarantee delivery under any circumstances. Notifications operate on a best-effort basis, subject to the operating system of the user's device; there is no guarantee of delivery, timeliness or visibility.
6.2. Causes of notification delivery failure
The effective delivery of notifications may be prevented or affected by factors entirely outside OwnAutoCare's control, including without limitation:
- notification permissions denied, revoked or modified by the user or by the operating system at any time;
- activation of Do Not Disturb, Focus, Airplane mode, silent mode or any other system restriction that blocks or filters notifications;
- battery-saving modes or background app refresh restrictions imposed by the operating system or configured by the user;
- device switched off, restarted, suspended, malfunctioning or unavailable at the time the notification was due to be delivered;
- uninstallation, reinstallation, update or failure of the application;
- operating system updates that change the behaviour of the notification system;
- insufficient storage space, memory or other system resources;
- device change without full data and preferences restoration;
- deletion of the reminder by the user after its creation;
- any other technical, network, hardware, software or configuration cause, regardless of its nature and origin.
OwnAutoCare does not guarantee, under any circumstances, the timely delivery, effective receipt or exact content of any notification.
6.3. Accuracy of calculations and dependence on user data
Reminders and estimated maintenance dates generated by OwnAutoCare (including without limitation reminders for vehicle inspection (MOT/ITV), oil changes, insurance renewal, brake inspection, tyres, battery, filters, timing belt or other maintenance operations) are calculated solely from data manually entered by the user. OwnAutoCare:
- does not verify and cannot verify the accuracy, truthfulness or completeness of data entered by the user;
- does not guarantee that the maintenance intervals applied by the application are correct or appropriate for the user's specific vehicle, its usage history, environmental conditions or actual state;
- does not guarantee that reminders correspond to the actual legal or technical expiry dates applicable to the vehicle;
- is not responsible for calculation errors arising from absent, duplicated, incorrect, outdated or erroneously entered data.
Responsibility for entering, maintaining and updating accurate and complete data rests exclusively with the user.
6.4. OwnAutoCare is not a compliance system or professional adviser
OwnAutoCare is exclusively a personal organisation and record-keeping tool. Its reminders do not constitute, under any circumstances:
- technical or mechanical advice on the condition, safety or roadworthiness of the vehicle;
- legal or regulatory advice on obligations related to the vehicle or its use;
- insurance advice, coverage confirmation or policy validity certification;
- an official or certified vehicle compliance monitoring system;
- a substitute for the judgement of a mechanic, inspection engineer, lawyer, loss adjuster or any other qualified professional.
6.5. User duty of active supervision and independent verification
The user expressly acknowledges and agrees that:
- the user is solely and exclusively responsible for knowing, monitoring and at all times complying with all legal and technical obligations applicable to their vehicle, entirely independently of OwnAutoCare reminders;
- receipt of a reminder does not relieve the user of the obligation to independently verify actual compliance with those obligations;
- non-receipt of a reminder, or its late or incorrect receipt, does not suspend, modify or extinguish any legal obligation of the user nor release the user from its legal consequences;
- the user must verify directly with the competent official authorities (national vehicle registration authority, inspection stations, insurers, authorised workshops or others) the expiry dates of the MOT/ITV, mandatory insurance and any other legal or technical vehicle obligation;
- the user may not invoke OwnAutoCare reminders as an excuse, mitigating factor or justification of any kind before authorities, insurers, courts or third parties.
7. Limitation of liability
7.1. OwnAutoCare is made available to the user "as is" and "as available", without any warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability or freedom from errors or vulnerabilities.
7.2. To the fullest extent permitted by applicable Spanish and European law, OwnAutoCare, its developer and its collaborators shall not be liable, under any legal theory (contractual, tortious, strict liability, quasi-contractual or otherwise), for any damages, losses or claims of any kind, whether direct, indirect, incidental, special, consequential, or punitive, arising out of or in connection with the use of the application, including without limitation:
- fines, penalties, surcharges or administrative, civil or criminal sanctions arising from driving with an expired MOT/ITV, without valid mandatory insurance, or without any other legally required vehicle documentation or requirement;
- cancellation, rescission, suspension, loss of coverage, excess charges or premium increases under any insurance policy;
- road traffic accidents, incidents or collisions of any nature;
- mechanical damage, breakdowns, accelerated wear or destruction of the vehicle or any of its components, including engine, braking system, tyres, battery, timing belt or others;
- personal injury, bodily harm, injury of any degree or death of the user or third parties;
- property damage, whether the user's own or third parties';
- loss, corruption, inaccessibility or destruction of data stored in Google Drive, iCloud or any other storage service;
- economic losses, loss of profit, loss of opportunity or financial harm of any nature;
- any other loss of any nature arising directly or indirectly from: (i) a notification not received, delivered late or with inaccurate content; (ii) incorrect, incomplete or outdated data entered by the user; (iii) the user's reliance on OwnAutoCare reminders or calculations, whether as the sole or primary source of information, for meeting legal or technical obligations; (iv) use or inability to use the application for any reason.
The above exclusion shall apply regardless of whether OwnAutoCare had been informed of or could have foreseen the possibility of such damage, and regardless of the cause, including calculation errors, technical failures, force majeure or fortuitous events.
7.3. OwnAutoCare accepts no liability for interruptions, failures, changes in service terms, data loss or any other incident originating in third-party services, including without limitation Google Drive, Google Sign-In, iCloud, CloudKit, Apple Sign-In, iOS, iPadOS, macOS or Android operating systems, nor for the policies, decisions or acts of Apple Inc., Google LLC or any other third party.
7.4. The total and aggregate liability of OwnAutoCare to the user, for any cause and under any legal theory, shall in no case exceed the total amount actually paid by the user to OwnAutoCare in the twelve (12) months preceding the event giving rise to the claim. As OwnAutoCare is completely free to download and use, that maximum cap is zero euros (EUR 0).
7.5. Certain jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above exclusions and limitations shall apply to the fullest extent permitted by law. Nothing in this clause shall limit OwnAutoCare's liability in cases where such limitation is expressly prohibited by applicable law, nor in cases of wilful misconduct or gross negligence directly attributable to the developer under Spanish law.
8. Changes
We may update these terms occasionally. We will notify you of significant changes through the application. Continued use after changes implies acceptance of the new terms.
9. Governing law
These terms are governed by Spanish law. For any dispute arising from the use of the application, the parties submit to the competent courts in accordance with applicable law.
